Terms of Use

Welcome to cSync! These Terms of Use ("Terms") govern your use of the cSync iOS application ("App"). By downloading, installing, or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using cSync, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Echo.Liao ("Developer," "we," "us," or "our").

2. License Grant

2.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal iOS device(s)
• Use the App for personal, non-commercial purposes
• Access features according to your subscription tier

2.2 License Restrictions

You may NOT:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App for commercial purposes without permission
• Share your subscription with others
• Circumvent or bypass quota limitations or subscription features
• Use the App in any unlawful manner

3. Subscription Terms

3.1 Free Tier

The free version includes:

• Basic contact management features
• Limited duplicate merges (as specified in the app)
• Limited advanced searches
• Limited backup operations

3.2 Pro Subscription

The Pro subscription includes:

• Unlimited duplicate contact merging
• Unlimited advanced searches
• Unlimited contact backups
• Priority support
• No advertisements

3.3 Subscription Plans

• Weekly: Auto-renews every 7 days
• Yearly: Auto-renews every year

3.4 Payment and Renewal

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• Pricing is displayed in the App Store and may vary by country

3.5 Free Trial

• First-time subscribers may receive a free trial period (e.g., 3 days)
• You will be charged when the trial period ends unless you cancel
• To cancel, disable auto-renewal in iOS Settings before the trial ends

3.6 Cancellation

• You can cancel your subscription at any time through iOS Settings → [Your Name] → Subscriptions
• Cancellation takes effect at the end of the current billing period
• No refunds for partial periods
• You retain access to Pro features until the end of the paid period

3.7 Refunds

• All purchases are processed through Apple's App Store
• Refund requests must be submitted to Apple through your purchase history
• We do not control Apple's refund policies or decisions

4. User Responsibilities

4.1 Contact Data

You are solely responsible for:

• The accuracy and legality of your contact data
• Backing up your contacts before using merge or delete features
• Compliance with privacy laws regarding contact information
• Obtaining necessary permissions to store and use contact information

4.2 iCloud Sync

• iCloud sync requires an active iCloud account
• You are responsible for managing your iCloud storage
• We are not liable for iCloud service interruptions or data loss

4.3 Device Requirements

• iOS device running iOS 15.0 or later
• Active internet connection for subscription validation
• Sufficient storage space on your device

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the subscription in the 12 months preceding the claim
• For free tier users, our liability is limited to $10 USD
• We are not liable for third-party services (Apple, iCloud) or their failures

7. Indemnification

You agree to indemnify, defend, and hold harmless the Developer from any claims, damages, losses, liabilities, and expenses arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your contact data or its use

8. Intellectual Property

All intellectual property rights in the App, including but not limited to:

• Source code and software
• Design, graphics, and user interface
• App name, logo, and trademarks
• Documentation and materials

remain the exclusive property of the Developer. These Terms do not grant you any ownership rights.

9. App Updates and Changes

We reserve the right to:

• Modify, suspend, or discontinue any feature at any time
• Update subscription pricing (with notice to existing subscribers)
• Change quota limits for free tier users
• Release updates or new versions

Continued use after changes constitutes acceptance of the modified terms.

10. Termination

10.1 By You

• You may stop using the App at any time
• Uninstalling the App terminates your license
• Cancel subscriptions through iOS Settings

10.2 By Us

We may terminate or suspend your access if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse or misuse the App
• Attempt to circumvent subscription or quota systems

10.3 Effect of Termination

• Your license to use the App ends immediately
• You must stop using the App and delete it
• No refunds for remaining subscription period
• Local data remains on your device unless you delete the App

11. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our data practices.

12. Third-Party Services

The App integrates with:

• Apple App Store: Subscription and payment processing
• iCloud: Optional cloud backup and sync
• iOS Contacts: Contact data access

These services are governed by Apple's terms and policies. We are not responsible for third-party services.

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

13.2 Dispute Resolution

• Informal resolution: Contact us first to resolve disputes
• If unresolved: Disputes shall be resolved through binding arbitration
• Small claims court: You may pursue claims in small claims court if they qualify

13.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or class arbitrations.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and the Developer regarding the App.

16. Changes to Terms

We may modify these Terms at any time. Changes will be effective immediately upon posting in the App or on this page. Material changes will be notified through the App. Continued use constitutes acceptance of modified Terms.

18. Apple Requirements

Acknowledgment: You acknowledge that these Terms are between you and the Developer, not Apple. The Developer is solely responsible for the App and its content.

• Apple has no obligation to provide maintenance or support
• Apple is not responsible for addressing claims related to the App
• Apple is a third-party beneficiary of these Terms
• Apple may enforce these Terms against you as a third-party beneficiary
